Whether the marriage is established formally, or at common law, there are several grounds on which a party may seek to dissolve his or her marriage such as adultery or cruelty on the part of one spouse. Texas also recognizes a no-fault ground to dissolve a marriage known as "insupportability." If a party seeks to divorce his or her common law spouse, he or she should do so within two years of separation.

Parties frequently agree that their marriage is insupportable with no expectation of reconciliation; however, they often disagree over issues pertaining to their children and their property. An "uncontested" divorce involves agreement as to all issues; whereas a "contested" divorce involves disagreement of any one or more issues.
